These Terms of Service (“Terms”) govern your use of hinkik.com and purchases from Hinkik Jewelry (“Hinkik,” “we,” “us,” or “our”). By accessing the Store or placing an order, you agree to these Terms and the policies linked below. If you do not agree, please do not use the Store.

1. Store platform

Our Store is hosted by Shopify, which provides the ecommerce platform we use to offer products and process orders. Your contract for the purchase of products is with Hinkik Jewelry, not Shopify.

2. Eligibility and accounts

You must have legal capacity to enter into a purchase. If you are under the age of legal majority where you live, you may use the Store only with the involvement and permission of a parent or legal guardian. You are responsible for providing accurate information and for keeping your account credentials confidential. Notify us promptly of suspected unauthorized account use.

3. Product information

We aim to describe product materials, dimensions, finishes, images, and availability accurately. Because jewelry may be handmade or use natural materials, minor variations in color, texture, shape, measurements, or finish may occur and are not necessarily defects. Screen settings and lighting may also affect how colors appear. Product descriptions and availability may be corrected or updated where reasonably necessary.

4. Prices, currency, taxes, and promotions

Prices and available currencies are shown in the Store and confirmed at checkout. Your bank or payment provider may apply exchange rates or fees. Shipping charges, taxes, and import duties are handled as shown at checkout and in our Shipping Policy. Promotions are subject to their stated dates, eligibility, exclusions, and stock availability and cannot be combined unless expressly stated.

5. Orders and payment

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not guarantee acceptance. We may reject or cancel an order for reasons such as unavailable stock, a material pricing or product-information error, suspected fraud, payment failure, shipping restrictions, or legal requirements. If payment has been captured for an order we cancel, we will refund the amount paid to the original payment method.

You agree to provide current and accurate billing, contact, and delivery information. Payments are processed by the payment methods and providers offered at checkout. Payment providers may apply their own terms, verification, and processing times.

6. Cancellation before shipment

To request cancellation, contact us as soon as possible before shipment. We cannot guarantee cancellation after preparation, sourcing, personalization, or shipment has begun. Custom, personalized, and pre-order items may not be cancellable once work or procurement has started. If an order has already shipped, any return is governed by our Refund Policy. Approved cancellations are refunded to the original payment method; bank or payment-provider processing time may apply.

7. Shipping and delivery

Processing times, estimated delivery times, tracking, customs responsibilities, and procedures for delayed, lost, damaged, or returned parcels are described in our Shipping Policy. Delivery dates are estimates unless we expressly agree otherwise.

8. Returns, exchanges, and refunds

Eligibility, time limits, exclusions, condition requirements, return authorization, exchanges, and refund timing are governed by our Refund Policy. Please contact us before sending any return. Nothing in these Terms limits any consumer right that cannot lawfully be excluded.

9. Acceptable use

You must not use the Store or its content for an unlawful, fraudulent, harmful, abusive, infringing, or unauthorized purpose; introduce malicious code; attempt to bypass security; scrape or interfere with the Store; impersonate another person; or submit false or misleading information. We may restrict access or cancel affected orders where reasonably necessary to protect the Store, customers, or third parties.

10. Intellectual property

Unless otherwise stated, the Store content—including the Hinkik name and logos, product images, text, graphics, and designs—is owned by or licensed to Hinkik Jewelry and is protected by applicable intellectual-property laws. You may use the Store for personal, non-commercial shopping only. Reproduction, modification, distribution, sale, or commercial use requires our prior written permission.

11. Third-party services and links

The Store may include services or links provided by Shopify, payment providers, delivery providers, social platforms, and other third parties. Their services may be subject to their own terms and policies. To the extent permitted by law, we are not responsible for third-party websites or services that we do not control.

12. Personal data

Our collection and use of personal data is described in our Privacy Policy. By using third-party payment, delivery, or platform services, you may also be subject to those providers’ privacy notices.

13. Store availability and errors

We may correct typographical, pricing, inventory, shipping, or other errors and update Store content. We do not guarantee uninterrupted or error-free access, but we will use reasonable efforts to operate the Store securely and reliably. We may suspend or change features when necessary for maintenance, security, legal, or operational reasons.

14. Liability and consumer rights

To the fullest extent permitted by law, Hinkik Jewelry is not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable or caused by matters outside our reasonable control. We do not exclude or limit liability where it would be unlawful to do so, including liability for fraud, willful misconduct, or rights and remedies that applicable consumer law does not permit us to exclude.

15. Changes to these Terms

We may update these Terms to reflect changes in our Store, practices, or legal requirements. The revised Terms will be posted on this page with an updated date. Changes apply prospectively from publication unless applicable law requires otherwise.

16. Governing law

These Terms and purchases from the Store are governed by the laws of Thailand, without limiting any mandatory consumer protections that apply in your country of residence. The parties should first attempt to resolve any dispute in good faith.
